Are you having difficulties visiting with your grandchildren?
Do you have a grandchild who is being treated poorly or even abused? Do you know your legal rights as a Grandparent? |
Dear Grandparent, You are NOT alone! Unfortunately, with the number of divorces escalating at a frightening rate, more and more grandparents just like you are experiencing fear and despondency regarding the fate of their beloved grandchildren. * You may have difficulty seeing them on a steady basis or you may have been denied visits altogether. *After a small fight or minor disagreement you find that you are not allowed to visit or your Grandkids are denied sleepovers at your home… even gifts are not allowed to be given. You realize that you are being paid back for getting “out of line.” (Sometimes this happens for just making suggestions to your daughter or son-in-law.) * You may suspect, or even know, that they are neglected and possibly abused; maybe even left alone for long periods of time without loving supervision or protection. * You may fear that they are being unduly disciplined by some “stranger” who has moved in with the child’s parent. * You have heard “inklings” from neighbors, or relatives, or the child, about drugs and parties, and many “friends” coming and going. * You may have found that they are being "warehoused" in daycare. * You may realize that they have been "given" to the other Grandparents.
"It’s especially hard around a holiday or their birthday, when I know I won’t even be able to talk to them on the phone…" Our nationally-known experts have developed two bestselling books, with the goal of arming you with all of the up-to-date information regarding your legal rights, as well as to guide you, step by step, through the process of exercising those rights. Introducing.... |
These two books represent the
largest volume of current information
and guidance available on this subject
When I’m talking to people on the phone and they ask me what is the difference between the two books, here is what I tell them: “The Grandparents’ Rights Manual tells you what you CAN DO… what your options are. The second book, Grandparents Going to Court to Assert Their Rights shows you HOW TO DO IT…what the process looks like. It covers everything, including how to testify and even what to wear in court. The two books combined, cover the subject of Grandparents’ Rights like no other source.”

CHAPTER TWO
How to Find the Right Attorney To Handle Your Case The most important "piece of the puzzle" in winning your custody case is selecting the RIGHT lawyer! Dr. Barry Bricklin and Dr. Gail Elliot, nationally-known child custody experts, have used their 40 years of custody experience to help you select the attorney who will do the best job for YOU! (BIOGRAPHIES of Dr. Bricklin and Dr. Elliot) |
CHAPTER THREE
25 Key Strategies to Help You Achieve A Successful Conclusion To Your Court Case "FROM DR. BRICKLIN AND DR. ELLIOT" FOURTEEN KEY STRATEGIES FOR YOU TO USE "We have carefully tracked all of the factors that seem to hold true with people who do well in custody disputes. That is, we compared the strategies used by people who do well in such disputes with those who do not do well, and have identified fourteen key items that we think are of particular importance." STRATEGIES THAT MAY BE USED AGAINST YOU
"Here we will deal with a number of strategies that could be used to damage your position."
FOUR STRATEGIES THAT CAN BE EFFECTIVE WHEN A CHILD HAS BEEN BRIBED OR MANIPULATED INTO TURNING AGAINST ONE OF THE PARENTS "Of course, the major strategy that could be used against you is for the children to have been alienated from you. This may have been done in subtle ways that escaped detection, or it may have been done prior to any opportunity for a trained evaluator to spot it." |
CHAPTER FOUR
Things for Grandmothers (women) and Grandfathers (men) to Be Aware of When in Custody Court WOMEN AND MEN ARE TREATED DIFFERENTLY DURING CHILD CUSTODY COURT CASES AND IT IS EXTREMELY IMPORTANT TO BE IN A POSITION TO COUNTERACT THESE JUDICIAL BIASES From Dr. Bricklin and Dr. Elliot:
"One of the things we want to cover is what is called in the scientific community the role of "bias." Biases are behaviors (here, we speak of those we observed in the psycholegal world) that can work against you, even though the so-called negative item does not really predict bad or poor parenting skills. A bias is much like a prejudice. We call a criticism "prejudiced" if we feel that a person is being faulted for something that does not really point to any true negative. We have observed the prejudices covered here among judges who are otherwise fairly intelligent and well meaning.
It is of upmost importance to understand these biases (or prejudices) so you can counteract their effect on your custody case. Example: If you knew that female judges were prejudiced against men who wear sports shirts because they believed that they were flaunting their masculinity YOU WOULDN'T WEAR A SPORTS SHIRT TO COURT." |
CHAPTER FIVE
Everything You Need To Know About Custody Evaluations
THE CUSTODY EVALUATION MAY BE A CRITICAL ELEMENT IN THE DECISION-
MAKING PROCESS OF YOUR CHILD CUSTODY CASE. IT WOULD NOT BE UNUSUAL FOR THE JUDGE HANDLING YOUR CASE TO ORDER A CUSTODY EVALUATION BE SUBMITTED TO THE COURT. WHAT CAN YOU EXPECT? WHAT DO EVALUATORS LOOK FOR DURING A COMPREHENSIVE CUSTODY EVALUATION? CAN YOU PREPARE FOR A CUSTODY EVALUATION?
What are Custody Evaluations? In most states when there is a custody dispute, the Court appoints a custody evaluator. That evaluator may work for Court Services or may be a private individual. In a "Custody Evaluation" an evaluator meets with the parties and evaluates the custody issues based on the factors for determining custody that are spelled out by state statutes. Once the custody evaluation is complete the evaluator submits a report to the Court which will recommend a custody and visitation schedule that the evaluator believes is in the child's best interests. Many times this report is a critical element of your case. Although custody studies may be challenged in court, many Judge's defer to the recommendations of the evaluator because, unlike the parties, they are deemed to be an independent witness without any personal Interest in the outcome. As a result, how you relate your case to the evaluator is very important. |
