What are Custody Evaluations?

In most states when there is a custody dispute, the Court appoints a custody evaluator. That evaluator may work for Court Services or may be a private individual.

In a "Custody Evaluation" an evaluator meets with the parties and evaluates the custody issues based on the factors for determining custody that are spelled out by state statutes.

Once the custody evaluation is complete the evaluator submits a report to the Court which will recommend a custody and visitation schedule that the evaluator believes is in the child's best interests.

This report is a critical element of your case.

Although custody studies may be challenged in court, many Judge's defer to the recommendations of the evaluator because, unlike the parties, they are deemed to be an independent witness without any personal Interest in the outcome. As a result, how you relate your case to the evaluator is very important.

A Checklist to Make Certain That You Are Fully Prepared For Your Custody or Visitation Court Case

There are many items to think about and consider as you prepare to get involved, or re-involved, in any custody dispute. This list will help you better organize these items. CHAPTER FIVE

Things for Women to be Aware of When in Custody Court

WOMEN AND MEN ARE TREATED DIFFERENTLY DURING CHILD CUSTODY COURT CASES AND IT IS EXTREMELY IMPORTANT TO BE IN A POSITION TO COUNTERACT THESE JUDICIAL BIASES

From Dr. Bricklin and Dr. Elliot:

"One of the things we want to cover is what is called in the scientific community the role of "bias." Biases are behaviors (here, we speak of those we observed in the psycholegal world) that can work against you, even though the so-called negative item does not really predict bad or poor parenting skills. A bias is much like a prejudice. We call a criticism "prejudiced" if we feel that a person is being faulted for something that does not really point to any true negative. We have observed the prejudices covered here among judges who are otherwise fairly intelligent and well meaning.

It is of upmost importance to understand these biases (or prejudices) so you can counteract their effect on your custody case. Example: If you knew that female judges were prejudiced against women who wear short skirts because they believed that they were flaunting their sexuality YOU WOULDN'T WEAR A SHORT SKIRT TO COURT."
